Hiring Policies

 

1. WORKING DAY: Each day will be scheduled for ten (10) hours of work from call time at location until wrap, including a 30-minute lunch. Additional time beyond 10 hours will be subject to the following overtime penalties: Between hour 10 and hour 12: 1.5x the hourly rate. Beyond hour 12: 2x the hourly rate ($200/hr). Beyond hour 15: 3x the hourly rate.

Each work day shall be separated by an interval of no less than twelve (12) hours.

Any additional days of shooting added after the signing of a contract will be the sole responsibility of the CLIENT to pay required crew and equipment fees.

2. PAYMENT: CLIENT agrees to pay PRODUCER for PROJECT by bank draft, certified check, Venmo or Paypal.

3. RESHOOTS: CLIENT will be charged an additional fee and expenses for any required reshoot requested by the CLIENT, and be subject to all the terms and conditions of this contract.

4. CANCELLATION POLICY: If the PROJECT is canceled or called off by CLIENT for any reason whatsoever within twenty-four (24) hours of the shoot's call time or after 8:00am the previous day (whichever comes first), a 100% fee for that day's rate will apply to PRODUCER, payable by CLIENT.

Any “holds” that have not been confirmed or canceled within 24 hrs of the shoot's start day shall be considered “booked” and “confirmed” and subject to the cancellation policy prescribed above.

5. NONPAYMENT: CLIENT agrees that failure to pay the amount specified within thirty (30) days of the shoot date will result in overdue payment, and be subject to at 10% additional charge by PRODUCER. PRODUCER is represented legally by Szabo and Associates, Atlanta GA, 404-266-2464. Dissatisfaction by the CLIENT with the quality of the video captured after the shoot has wrapped will not constitute a valid reason for nonpayment.

6. LIMIT OF LIABILITY: In the unlikely event that a crewmember is injured or becomes too ill to cover the PROJECT, PRODUCER will make every effort to secure a replacement. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of that crewmember's payment received for the PROJECT. If a replacement crew has been found, and the CLIENT terminates the contract in spite of the replacement being able and available, refunds are limited to any payments made above and beyond the shoot deposit. PRODUCER takes the utmost care with respect to exposure, transportation, and processing the video footage. However, in the unlikely event that any footage has been lost, stolen, or destroyed for reasons within or beyond PRODUCER’S control during the PROJECT, PRODUCER shall not be held liable.

7. MEALS: CLIENT agrees to provide at least one healthy, nutritious meal per day to PRODUCER and all crewmembers (or the cost and time necessary for the crew to purchase on their own). A lunch shall be provided after working at least five (5) hours of the 10-hour day, with at least a 30-minute break for eating food. If a meal is not provided in any given day, a meal penalty will be added to the final bill equal to 1 hour of overtime (1.5x the hourly rate). Snacks and drinks for crew shall also be provided to crew throughout the day. Meal time is included in the 10-hour day rate.

8. ADDITIONAL EXPENSES: CLIENT agrees to cover any additional travel-related expenses, including taxi or Uber costs, parking fees, and baggage fees incurred during the duration of the shoot. Any additional equipment rented through PRODUCER will be reimbursed 100% by CLIENT at the conclusion of the PROJECT.
